What a liability waiver template should include

A good waiver is plain, specific and honest about what it can and cannot do. This generator always includes:

  • The parties and a description of the activity.
  • An acknowledgment of the risks of the activity, written for your industry.
  • Voluntary participation and assumption of risk.
  • A release and waiver of claims "to the fullest extent permitted by law" that does not purport to release gross negligence or intentional or reckless misconduct.
  • A covenant not to sue and moderate indemnification.
  • A health and fitness statement and, if you want them, a medical authorization, photo and media consent and an emergency contact block.
  • Parent or guardian consent, only when minors are involved, with a note that enforceability varies by state.
  • Severability, entire agreement, governing law with your state, and signature, printed name and date lines.

A note before you use any template

This site is not a law firm and does not give legal advice. A waiver is one tool, not a shield: it may not apply to every claim, it may not bind people who did not sign it, and how it is treated differs from state to state. Read what a liability waiver is and how enforceability varies, and have a licensed attorney in your state review your document.

Questions and answers

What should a liability waiver include?

A liability waiver should name the parties and the activity, list the risks the person is accepting, state that taking part is voluntary, release the business from claims to the fullest extent the law allows (without trying to cover gross negligence or intentional misconduct), include a promise not to sue and a moderate indemnification clause, add a health statement and, where it applies, a medical authorization and parent or guardian consent for minors. It should also have severability, an entire-agreement clause, governing law, and signature, name and date lines. This generator builds all of these.

Is a liability waiver legally binding?

Often, if it is properly drafted and signed, but enforceability varies by state and a waiver generally cannot cover gross negligence or intentional misconduct. Courts often look at whether the language is clear, whether the person signed voluntarily, and whether the release is reasonable in scope. Consult a licensed attorney in your state before relying on any template.

Can a parent sign a waiver for a minor?

A parent or legal guardian can sign for a minor, but releases signed on behalf of minors are not enforceable in some states, and courts in other states may treat them differently. The generator adds a parent or guardian consent block and says in the document that enforceability varies by state. Ask a licensed attorney in your state.

Is this free?

The full preview is free: you can answer every question, read every clause and edit the text without paying. PDF and Word downloads are paid: $12 for a single document or $49 for the Business Starter Pack, one time. Payments are opening soon.

Is my information stored?

No. What you type stays in your browser. The document is built on your device and nothing you enter is sent to our servers. If you choose to keep your answers on this device, they are saved in your browser's local storage, and you can clear them with one button.

Can I edit the template?

Yes. Turn on "Edit any clause" in the preview to change the wording of any paragraph. Your edits stay on your device and are used in the PDF and Word files.

Do I need a lawyer to use this?

These are general templates, not legal advice. Laws vary by state, so have a licensed attorney in your state review the document before you use it, especially for high-risk activities or when children take part.
